  1. General Provisions

1.1. The management of this website https://latindance4you.com/ (hereinafter referred to as the “Website”) is carried out by Sole Proprietor Diana Mykhailivna Shvydka, registered with the Unified State Register of Legal Entities of Ukraine under code 3200624064, who is registered and operates in compliance with Ukrainian legislation (hereinafter referred to as the “SP”).

1.2. The SP greatly respects the confidential (personal) information of all individuals who visit the Website and those who use the services provided by the Website. We strive to protect the privacy of our clients’ personal data (information or a collection of information about an individual who is identified or can be specifically identified). Therefore, the SP aims to safeguard privacy by creating and ensuring the most comfortable conditions for every Website user.

1.3. This Privacy Policy (hereinafter referred to as the “Policy”) sets out the procedure for collecting, processing, using, and protecting the personal data we collect from our Website clients.

1.4. The Client’s personal data is processed in accordance with the General Data Protection Regulation (GDPR) of the European Parliament and Council (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, as well as other regulations, throughout the entire period of personal data processing.

1.5. Terms used in the Privacy Policy:

1.5.1. Personal data refers to any information related to an identified or identifiable individual, especially by an identifier such as a name, personal identification number, location, or internet identifier, or by one or more physical, physiological, genetic, mental, economic, cultural, or social identifiers.

1.5.2. Data Subject refers to an individual, including the SP’s clients and Website visitors, whose personal data is collected by the SP.

1.5.3. Consent of the Data Subject means any freely given, specific, and unambiguous indication of the Data Subject’s agreement to the processing of personal data concerning him or her.

1.5.4. Data processing means any action (operation) or set of actions (operations) carried out on personal data, whether or not by automated means, including collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

1.5.6. Controller is any natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

1.5.7. Data Processor is any natural or legal person, public authority, agency, or other body which processes personal data on behalf of the Controller. The SP’s employees are not considered Data Processors.

1.5.8. Cookie is a small piece of text information created automatically while browsing the website and stored on your computer or other device.

1.5.9. Personal data breach refers to a security breach that results in accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access to personal data transmitted, stored, or otherwise processed.

2.1. The owner and controller of the personal data of the Website users is Sole Proprietor Diana Mykhailivna Shvydka.

2.2. The SP may collect the following personal data from clients: names, mobile phone numbers, email addresses, payment information, images. The SP only collects personal data provided consciously and voluntarily by you as the data subject for the purpose of using the Website services, which constitutes your consent as the data subject to process personal data for the purpose specified in this Policy.

2.3. When visiting the Website, all login attempts are recorded. Other user traffic information is not processed or stored.

2.4. The SP processes clients’ personal data on a lawful basis and/or in legitimate interests that do not limit the interests, rights, and freedoms of the clients.

2.5. The SP collects personal data from clients for the following purposes:

  1. a) Communication – the SP may use personal data to communicate with clients about their orders or respond to their inquiries.
  2. b) Creation of video greetings – the SP may use personal data, including images/photos, to create unique video greetings for clients.
  3. c) Order delivery – the SP may use personal data to deliver orders to clients via email or messaging services.
  4. d) For administrative purposes related to accounting documents related to order services.
  5. e) To protect rights and legitimate interests, in resolving legal disputes.
  6. f) For identifying clients on the Website.
  7. g) For other purposes associated with legal obligations and SP responsibility.

2.6. The SP processes personal data as follows:

2.6.1. For the performance of a contract, where the data subject is a party, or to take steps at the data subject’s request prior to entering into a contract (legal basis: Article 6(1)(b) GDPR).

2.6.2. For the purposes of identifying, protecting, and resolving claims that may arise between the client and the SP and for other purposes necessary for the SP’s legitimate interests or a third party (legal basis: Article 6(1)(f) GDPR).

2.6.3. For invoicing and storing records, as well as for handling complaints within the time and manner required by law (legal basis: Article 6(1)(c) GDPR).

2.7. If the SP wishes to use client data for purposes for which it has no contractual or other legal grounds, the SP will request client consent.

2.8. The personal data provided by clients is processed and may be stored in a Data Center containing equipment supporting the Website services. Data centers are located in Ukraine. Personal data may be stored in the Database for Personal Data or a separate table within the Website’s database.

3.1. The SP takes responsible measures to protect personal data from unauthorized access, disclosure, alteration, or destruction. The SP uses secure servers and encryption technologies for data protection. However, we cannot guarantee the security of personal data transmitted over the internet or stored on our servers.

4.1. SP employees and authorized individuals have access to personal data only to perform job functions within their position and role in the SP.

4.2. All data recipients to whom the SP transfers (or may transfer) personal data are required (or will be required) by law to protect confidential information. Without client consent or request, the SP will not disclose personal data to individuals not listed in this Policy unless required by applicable law.

4.3. When providing services, complying with legal requirements, and fulfilling its obligations and responsibilities, the SP may obtain or transfer clients’ personal data to government or law enforcement agencies, service providers, debt collection participants, private or public bailiffs, or others as required by law.

4.4. In all other cases not specified in this section, the SP does not disclose personal data to third parties.

5.1. Personal data is stored for the entire period of cooperation and as long as necessary to fulfill and administer the contract or provide services ordered by the client. The retention period may range from 1 to 50 years, depending on data processing purposes and statutory requirements. In cases without statutory time limits, the SP stores various personal data considering the purposes and legal bases for processing.

6.1. The client has the right to access, update, and delete personal data held by the SP. Clients may also object to data processing or request restrictions. Clients may file a complaint directly to the SP or its data protection representative. To exercise these rights, contact us via our contact form.

  1. Changes to the Privacy Policy

7.1. The SP may update this Privacy Policy periodically. We will notify clients of significant changes by email or post a notice on our Website.

7.2. If the Privacy Policy changes, a new effective date will be determined.

7.3. The current version of the Policy is effective as of November 11, 2024.
